ScoreTrend Subscription Plans – Terms and Conditions

(hereinafter the “Owner”) makes all the exclusive services included in the paid ScoreTrend subscription plans available to its subscribers on a strictly personal basis. Such use is non-transferable to third parties and may not be used for commercial purposes in any form or for any reason.

Prohibition of scraping, theft, storage and resale of data and signals

All content made available through the Service – including, by way of example and without limitation, bookmaker odds, pre-match and live statistics, the values of our proprietary indicators (Goal Trend, Team Trend and any other present or future indicator), chart values and data, signals and analyses – is the exclusive property of the Owner and is protected by copyright and applicable intellectual property laws.

The User and any third party are strictly prohibited from:

• carrying out scraping, crawling, harvesting or any form of automated extraction of the data and of the pages of the website or application;
• copying, saving, archiving or storing in their own IT systems, databases or devices, in whole or in part, the odds, statistics, values of the proprietary indicators, chart data, signals and analyses;
• misappropriating (stealing) the data, signals and content of the Service by any means or technique;
• downloading the data via our socket, our dedicated APIs or any other technical tool. The data, including the odds provided by the APIs and the socket, may only be viewed on the website or mobile application and may not be used for any purpose other than viewing;
• selling, reselling, transferring, distributing, publishing or otherwise making available to third parties, whether free of charge or for consideration, the data, odds, statistics, indicators, charts, signals and analyses;
• opening an abnormal number of windows or connections in order to extract the data or cause IT malfunctions;
• using the data and signals to train, feed or develop third-party software, algorithms, models, services or products.

Our monitoring systems are advanced, and anyone found carrying out the activities described above will be immediately and permanently banned from the Service, with no right to any refund, and reported to the competent authorities. The Owner will provide the authorities with all data in its possession useful for identifying the person responsible for the breach, including logs, IP addresses and connection data recorded in our systems upon subscription, in the manner provided for by applicable law.

Anyone connecting via an “obfuscated” and therefore unidentifiable IP address will be banned from the Service with no right to any refund.

Tennis signals, TFI Scanner and Tennis TFI Bot

The provisions of the previous section apply in full to the Tennis section of ScoreTrend and to all its related proprietary indicators, data and tools.

In particular, the signals generated through the TFI Scanner and the signals sent or generated through the Tennis TFI Bot, together with their data, values, thresholds, parameters and analyses, are the exclusive property of the Owner, are protected by copyright and are intended solely for the personal use of the subscriber who purchased the plan.

It is expressly prohibited to transfer, communicate, forward, publish, share, sell or otherwise make available to third parties – on any basis, free of charge or for consideration – the TFI Scanner and Tennis TFI Bot signals, as well as the signals of the subscriber’s own strategies obtained through such tools. It is likewise prohibited to post such signals on Telegram channels, groups or bots other than the official one, on websites, social profiles, tipping services or any other channel, whether to obtain a direct or indirect economic benefit or to share the cost of the Service among several persons.

Prohibition of subscription sharing

The subscription is strictly personal and non-shareable. Each subscriber may use the Service only on one desktop device and one smartphone, both attributable to the subscription holder.

It is prohibited to share your access credentials, allow third parties to use the account, split the cost of the subscription with other persons, or use a single account for more than one person. Exceptions apply only where expressly authorised in writing by the Owner.

The User undertakes to use only the dedicated Telegram bot scoretrend_alertbot to receive notifications and not to enter the ID of a Telegram channel, group or other bot. Anyone using a tool other than the default Telegram bot will be immediately banned from the Service.

Consequences of breaches and claim for damages

Scraping, automated extraction, storage, downloading via socket or API, theft, transfer, sharing or resale of the data, statistics, indicators and signals (including those of the TFI Scanner and the Tennis TFI Bot), as well as the use of the Service for commercial purposes, are ordinarily carried out for purposes unrelated to personal use and therefore constitute an activity of a business, commercial or professional nature. In such cases – and in any event where the breach is committed by a legal entity or by a person acting for purposes relating to their business, commercial, craft or professional activity – the User is not a “consumer” within the meaning of section 2(3) of the UK Consumer Rights Act 2015 and authorises ScoreTrend and the Owner of the Service to claim, as liquidated damages representing a genuine pre-estimate of the loss suffered (including the economic value of the misappropriated data and the reputational and commercial harm), an amount of EUR 50,000, without prejudice to the proof and compensation of any greater loss actually suffered. Where the breach is committed by a legal entity, this amount shall be increased and quantified in court at a higher figure.

Where, instead, the breach is committed by a User who qualifies as a consumer under section 2(3) of the Consumer Rights Act 2015 and acts for purposes wholly or mainly outside any business activity, the Owner shall be entitled to compensation for the loss actually suffered, to be quantified in court, without prejudice to the immediate suspension and cancellation of the account with no right to any refund.

It is also prohibited to modify or alter the signals, analyses and data provided in an attempt to sell them or to deceive third parties into believing that they are the User’s own service rather than the official ScoreTrend channels.

Subscriber’s responsibilities and usage limitations

The ScoreTrend subscriber acknowledges and is fully aware that all content included in the subscription plan is for strictly personal, non-commercial use, in any form or manner. It is therefore expressly prohibited to post or send – on any other Telegram channel, website, to friends or acquaintances, to tipping or paid signal services, on web pages, social profiles or by e-mail – our signals and analyses, or the signals of the User’s own strategies obtained through ScoreTrend, whether to obtain a direct or indirect personal economic benefit or to split the cost of our services among several users.

The Owner will bring legal proceedings, in accordance with applicable civil and criminal law, against any subscriber or user of its services who engages in the actions described above.

The User is aware that the current subscription prices do not reflect the real value of the service offered but are underestimated, as major changes to the source code are underway. Our service is unique in its kind, handling all matches worldwide in real time with data updated every 30 seconds. Consequently, occasional disruptions may occur, but they will always be restored as quickly as possible.

With the chosen subscription plan (hereinafter the “Service”) – Starter, Premium, Advanced, Professional or ScoreTrend Free Plan – the User may access the services of the selected plan and use the ScoreTrend Alert Telegram bot (where included in the subscribed plan), which provides notifications of the strategies chosen by the User and/or the default strategies set by our team. Please read these terms and conditions (hereinafter the “Conditions”) carefully before using the ScoreTrend subscription plans. By using the Service, the User accepts the Conditions and undertakes to comply with them; otherwise, the Owner may deactivate the subscription at any time and take all measures permitted by law. The Owner may amend or update the Conditions, in whole or in part. Amendments and updates shall be binding as soon as they are published. The User is therefore invited to review the Conditions before accessing the chosen subscription plan.

Registration

To use the ScoreTrend subscription services, users must have reached the age of majority (18 years) and register via the dedicated form, providing truthfully and completely all the data requested, such as first name, surname, address of residence, postcode, province/county, country, tax code (where an Italian tax code is unavailable we will contact the person directly; if this is not possible, we will discontinue the service), e-mail and telephone number, required for invoicing, and accept these Conditions in full. The invoice will be sent to those who expressly request it, but in any event it will be issued for all those who use the service. In the event of incorrect or clearly false personal information, the Owner will print such information and file a report with the competent police authority. The User is responsible for safeguarding their access credentials. It is understood that in no event shall the Owner be liable for the loss, disclosure, theft or unauthorised use by third parties, on any basis, of Users’ access credentials.

Account cancellation and closure

Registered Users may stop using the Products at any time and deactivate and delete their account within their reserved area on the website https://scoretrend.net or by contacting the Owner directly at This email address is being protected from spambots. In the event of a breach by the User of these Conditions or of applicable legal provisions, the Owner reserves the right to suspend or close the User’s account at any time and without notice and to take legal action against them. If the account is cancelled, the User is aware that they will lose all strategies set in the dashboard and the parameters used, which cannot be restored in any way.

Purchase of the Service

Purchase of the Service is permitted both to Users who qualify as consumers and to users who do not. Under section 2(3) of the Consumer Rights Act 2015, a consumer is an individual acting wholly or mainly outside their trade, business, craft or profession. Individuals may purchase only on condition that they are at least eighteen years of age. The Owner undertakes to describe and present the Products and Services sold on the site in the best possible way. Nevertheless, some errors or inaccuracies may occur. The Owner reserves the right to change the price of the Service at any time. It is understood that any changes will in no way affect contracts already concluded before the change. The sale prices of the Service are inclusive of VAT; any other tax payable by the User will be indicated before confirmation of purchase. Payment for the Service may be made using the methods indicated on the site at the time of purchase. The site https://scoretrend.net uses third-party tools to process payments and does not in any way come into contact with the payment data provided (credit card numbers, cardholder names, passwords, etc.). Should such third-party tools decline payment authorisation, the Owner will not be able to provide the Service and will not be liable for any delay or failure to deliver.

Conclusion of the contract

The contract concluded through the site is deemed concluded when the User receives, by e-mail and/or through the display of a page of the Application, formal confirmation of the order, whereby the Owner accepts the order sent by the User and informs them that it may be processed. The contract is concluded at the place where the Owner’s registered office is located. The Owner reserves the right to refuse an order:

• when the Service is not available;
• when the Owner does not receive authorisation to charge the cost of the Service to the User;
• when, at the time of purchase, a clearly erroneous and recognisable price is indicated. In such a case, the User will be contacted by Customer Service to be informed and will receive a refund for the transaction carried out.

Until the User has received the confirmation referred to in the previous point, they may cancel the order by sending an e-mail to the Owner’s address, as further specified in the clause on the “Right of Withdrawal”.

Invoicing

The commercial invoice, if requested by the User, will be sent to the user who requests it. Anyone wishing to have an invoice issued to a recipient other than the account holder is asked to immediately send an e-mail with the new details and the username to which it refers. All payments received will be invoiced in accordance with the law and, for this reason, all invoicing data are required. Users who are not resident in Italy for tax purposes do not need an Italian tax code, as it is not required for invoicing. For the issuance of the invoice, the information provided by the User shall prevail; the User declares and warrants that such information is true and holds the Owner fully harmless in the event of incorrect or erroneous data.

Subscription

The ScoreTrend subscription plans require payment of a fee. Payments begin on the date specified at the time of subscription. The subscription does not renew automatically on a monthly basis: if desired, it must be renewed before expiry in order to continue using the Service.

Right of withdrawal (cancellation) for digital products and/or services

The Service consists of the supply of digital content and a digital service that is not provided on a tangible medium, with execution beginning as soon as access to the platform is enabled. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134), the right to cancel a distance contract for digital content is lost where the User has expressly consented to the supply beginning before the end of the 14-day cancellation period and has acknowledged that they thereby lose the right to cancel. The same Regulations exclude the right to cancel for contracts relating to gambling within the meaning of the Gambling Act 2005.

By subscribing and requesting immediate access to the Service, the User expressly requests that performance begin immediately and acknowledges that they lose the right to cancel once performance has begun. Exclusion of Warranty

The Service is provided “as is” and “as available”, and the Owner gives no express or implied warranty regarding the past or future results of the Telegram bot, nor any warranty that the purchased Service will meet Users’ needs, that it will never be interrupted, or that it will be free from errors or unforeseen bugs. The Owner will endeavour to ensure that the Service is available uninterruptedly 24 hours a day, but shall in no way be held liable if, for any reason, the Service is not accessible and/or operational at any time or for any period. The price, which is lower than the real value of the service, takes this eventuality into account. Access to the Service may be temporarily suspended without notice in the event of system failure, maintenance, repairs, or for reasons entirely beyond the Owner’s control or events of force majeure. Nothing in these Conditions affects the mandatory statutory rights of consumers under the Consumer Rights Act 2015.

Limitation of Liability

The User undertakes to hold harmless and indemnify the Owner (as well as any companies controlled by or affiliated with it, its representatives, collaborators, consultants, directors, agents, licensees, partners and employees) from any obligation or liability, including any legal costs incurred in defending itself in court, arising from damage caused through use of the Service to other Users or third parties, in connection with the Service purchased, breach of the terms of law or of these Conditions. Accordingly, the Owner shall not be liable for:

• any losses that are not a direct consequence of a breach of the Contract by the Owner;
• any loss of money arising from the use of the Services offered by ScoreTrend, including the notification Telegram bots, and any other loss, even indirect, that the User may suffer (such as, by way of example and without limitation, commercial losses, losses of money from bets placed, losses due to incorrect odds, data or statistics, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation, etc.);
• damage or loss arising from interruptions or malfunctions of the Service due to events of force majeure or, in any case, unforeseen and unforeseeable events beyond the Owner’s control, such as, by way of example and without limitation, faults or interruptions to telephone or electrical lines, the internet and/or other transmission tools, unavailability of websites, server malfunctions, incorrect values provided by our data providers, strikes, natural events, viruses and cyber-attacks, interruptions in the provision of third-party products, services or applications;
• improper or unsuitable use of the Service by Users or third parties;
• the issuance of incorrect tax documents due to errors relating to the data provided by the user, who is solely responsible for correct entry in the specific registration form.

To the extent permitted by law, and except in respect of liability that cannot be excluded or limited under applicable law, in no event shall the Owner’s liability exceed twice the cost paid by the user for the service used.

Links to third-party sites

The Service may contain links to third-party sites, such as bookmaker odds, live and pre-match statistics, etc. The Owner exercises no control over them and is therefore in no way responsible for the content of these sites. Some of these links may refer to third-party sites that provide services through the Service. In such cases, the individual services will be subject to the general terms of use of the site and of the service prepared by the third parties, in respect of which the Owner assumes no responsibility.

Force majeure

The Owner shall not be held liable for the failure or delay in performing its obligations set out herein due to circumstances beyond the Owner’s reasonable and foreseeable control. Performance of the Owner’s obligations under these Conditions shall be deemed suspended for the period during which Force Majeure Events occur. The Owner shall take any action within its power to identify solutions allowing the correct performance of its obligations despite the persistence of Force Majeure Events.

Waiver

No waiver by either party of any article of these Conditions shall be effective unless expressly stated to be a waiver and communicated in writing.

Severability

Should any provision of these Conditions be unlawful or invalid, it shall not be considered part of the General Conditions and this shall not affect the remaining provisions, which shall continue to be valid to the maximum extent permitted by law.

Amendments

The Owner reserves the right to amend these Conditions at any time, giving specific notice on the Application. The User acknowledges and accepts that any amendments to these Conditions will apply to orders sent by Users after the date of notice of the amendment.

Privacy

The protection and processing of personal data will take place in accordance with the Privacy Policy, available at https://scoretrend.net/en/privacy-policy.

Governing law and jurisdiction

These Conditions and any disputes concerning their performance, interpretation and validity are governed by Italian law and subject to the exclusive jurisdiction of the court of the place where the Owner is established. Where the User is a consumer, this does not deprive the User of the protection afforded by mandatory provisions of the law of the country in which the User is habitually resident, and the User may also be entitled to bring proceedings before the competent courts of their country of residence.
